    NFA Firearms Trust

A properly drafted Gun Trust can hold all types of legally transferrable firearms. There are some exceptions like C&R as a Trust may not hold a C&R license. Another is a pre or post ban dealer sample machine gun.

While we work with lawyers in other states, we are not creating the Colorado trust. We prepare a Gun Trust based on federal guidelines and to comply with the NFA. Our local lawyers in each state, make state specific modifications to make sure the trust complies with the state's laws.

Haven't heard anything, but I would not ever have a trustee that was not eligible. See the instructions on what to do if a trustee becomes ineligible.

Generally a simple amendment is all that is necessary. Some states do not require any changes. David Goldman Gun Trust Lawyer

They vary based upon your state. I am not sure what the rate is in your state in most states the cost to draft a trust to meet your desires as well as what is necessary to protect your family, review the trust with you, teach you how to use it, teach you how to purchase the NFA items correctly, and teach you how to avoid the common procedural violations of the NFA Runs around $600. In some states the fees tend to be higher, and if you have a taxable estate and additional tax analysis is necessary it can raise the costs also. There are differences in each state, some are significant and will make a valid trust in one state not valid in the other and others are minor and deal with wording, statutes, or preferences of the local attorneys.

There are two issues you need to be concerned with 1) under the NFA only someone over 18 can purchase an NFA firearm, (21 if you are purchasing it from a dealer or FFL) 2) your state laws on possession and use of firearms. Generally most states require minors to be in the presence and supervision of a firearm and then limit the firearms that can be used. Because this is a complicated issue, it is one that should be discussed with the attorney directly and you should not rely on facts and circumstances of others.

Most people in the Military have the option of doing the trust where they are living or where there residence of records is. The decision is often made by the local law as well what items you want to purchase. Most states will only sell handguns to residents (or trusts) that are located in the state or under the state's laws. I hope this helps

As far as the timing, there are some states that take a few extra days. As far as the documents, they are generally the same, but the signing requirements, and some language, and some of the provisions do differ from state to state. That is why we always work with a licensed attorney who reviews and makes modifications to our copyrighted trust to customize it for each state.

We normally turn the trusts around in 24 hours. The local attorney usually takes 1- 3 days and most have their completed signed trust within a week. I have a new document on What is a NFA Gun Trust? and Why Do I need a NFA Gun Trust? that you can read on the web or request from me by email.
