New ACT signed into effect by Malloy

Recommended Posts

I really need to get out of this state!

Malloy called a special session and signed into effect new law that allows someone to Anonimously file a restraining order against you and the police come get your guns, ammo and permit. WITH OUT INVESTIGATING THE REPORT! Also, THERE IS NO RECOURSE FOR YOU TO GET YOUR STUFF BACK IF YOU PROVE THAT IT WAS B.S.! So watch how you piss off your neighbors, GF's/BF's ex's whoever.

I would start by filing one against the governor and legislators. They are obviously too dangerous to have guns.

HB 5054 into effect 10/16

it's what is in effect right now in most states, thanks to Lautenberg.

In a domestic violence situation, a spouse or significant other can get a temporary restraining order without notice if a judge determines the application meets a legal threshold. If the TRO is issued, then the person has to surrender guns and ammo to the cops or someone else until a judge rules on the TRO. Under due process rules, the hearing has to be quick, usually within two weeks. If the TRO becomes a restraining order, the person has to surrender guns and ammo until the restraining order expires or is dissolved. At that point, the firearms are returned.

If the restraining order is permanent, then the right to own a firearm can only be reinstated if the restraining order is subsequently dissolved by a court.

It's not anonymous, and there is recourse.

Our legislature is doing just the opposite. It's trying to move victims of domestic violence to the front of the CCW line by issuing 45 day temporary Concealed Carry Permits. This gives the victim immediate relief until they can complete a CC class.

To enact R.S. 40:1379.3.2, relative to concealed handgun permits; to provide for the issuance of temporary concealed firearms permit; to authorize the temporary carrying of a concealed handgun without a permit for persons who have obtained a domestic abuse protective order; to provide for applicability; to provide for the application process; to provide relative to the effects of obtaining such a permit; to provide for time limitations; to provide relative to the payment of a fee; to provide for rulemaking; and to provide for related matters.

It's been sent to our new POS Governor for his signature. We'll see if he signs it.
